Federal Ombudsman Secretariat for Protection against Harassment of Women at Workplace was established in January 2011, under Section 7 of the Protection against Harassment of Women at Workplace Act, 2010. Ms Musarrat Hilali has been appointed as the first Federal Ombudsman. She is a renowned lawyer and had been Chairperson of the Tribunal on Environment Protection of Khyber Pakhtoon Khawah.
This Act is to protect the fundamental rights and dignity of the person as envisaged in Constitution of Islamic Republic of Pakistan and to make provision for protection against harassment of women at workplace.
It is the responsibility of the employer to ensure implementation of this Act, including but not limited to incorporate the Code of Conduct for protection against harassment at workplace as part of their management policy and to form Inquiry Committee to enquire into complaints under this Act. The management shell display the copies of Code in English as well as in language understood by the majority of employees at conspicuous places.
All Ministries, Divisions, Departments, Corporations or any autonomous or semi autonomous body, Educational Institutes, Medical facilities established or controlled by the Federal or Provincial Government or District Government or registered civil society associations, or privately managed a commercial or an industrial establishment or institution, a company as defined in the Companies Ordinance 1984 (XL VII of 1984) and including any other registered private sector organizations or Institutions are liable to implement the following.
Any unwelcome sexual advance, request for sexual favour or other verbal or written communication or physical conduct of a sexual nature or sexually demeaning attitudes, causing interference with work performance or creating an intimidating, hostile or offensive work environment, or the attempt to punish the complainant for refusal to comply to such a request or request or is made a condition for employment.
